NVIDIA employee detained in Taiwan over Supermicro smuggling scheme; GPU export diversion persists despite whitelist

Taiwan authorities detained an NVIDIA employee on suspicion of falsifying business documents in connection with the Supermicro GPU smuggling scandal, marking the first investigation to reach NVIDIA itself since the scheme surfaced in March. The unnamed employee, identified only by the surname Chang, is suspected of involvement in efforts to divert advanced GPUs into China, circumventing U.S. export controls. Prosecutors searched his home and workplace on July 24, citing strong suspicion of attempted flight risk and evidence destruction.

While NVIDIA as a company is not under investigation, the employee's involvement underscores widening pressure on the chipmaker's supply chain oversight. Since March, Taiwan has detained Supermicro co-founder Yih-Shyan Liaw, a Supermicro sales manager, and multiple distributor employees across Supermicro, Albatron Technology, and Chief Telecom—all accused of mislabeling servers destined for Southeast Asia and routing them to China instead. NVIDIA responded by creating a supplier "whitelist" and dispatching staff to customer data centers to verify intended use, following White House urging.

Demand for diverted high-end NVIDIA chips remains intense despite the legal channel available to Chinese firms, which covers only 75,000 units of older H-series GPUs for 10 approved companies at 25% government revenue share. The latest-generation Blackwell (B200, GB300) chips have no legal export pathway to China, making the smuggling route economically attractive. Taiwan is considering a criminal ban on AI chip exports to China to close remaining loopholes, but the investigation's reach into NVIDIA personnel signals that export controls alone cannot prevent motivated diversion attempts.
