Trump threatens 100% tariff on countries imposing digital services taxes
President Donald Trump on Friday threatened to impose a '100% TARIFF' on the goods of any country that imposes or plans to impose a digital services tax on U.S. companies. In a Truth Social post, he stated the tariff 'will supersede Trade Deals made with the Country, whether implemented, signed, or not' and 'will be immediately imposed' should countries proceed. He singled out 'Numerous European Countries' considering such taxes.
Digital services taxes are typically structured to apply only to the world's largest and most established tech companies—Meta, Alphabet, and Amazon—which are U.S. firms. More than a dozen countries have already imposed such taxes. Trump has previously vowed to retaliate; last year, he threatened to cut off all trade talks with Canada, which subsequently scrapped its proposed digital tax before implementation.
Legal and practical questions persist about Trump's authority to immediately impose such tariffs. The Supreme Court previously struck down Trump's 'reciprocal' tariffs, ruling that the International Emergency Economic Powers Act did not authorize unilateral sweeping tariffs. Trump later signed an executive order imposing a 10% global tariff under Section 122 of the Trade Act of 1974, but tariffs under that statute last only 150 days without congressional approval.
For cloud operators: digital services taxes have resurfaced as a negotiating lever in the U.S.-EU tech trade relationship. A 100% retaliatory tariff, if implemented, would dramatically escalate the cost of goods flowing into the U.S. from Europe and other affected jurisdictions. The threat will likely soften negotiating positions in countries considering or implementing such taxes, but the enforceability of such tariffs remains constitutionally unclear without new congressional action.
